E' proprio necessario istituire un pool nazionale di magistrati esperti nei reati in materia di salute e sicurezza sul lavoro ? A nostro parere nelle maggiori città del paese vi sono le competenze sia dei magistrati sia dei consulenti delle parti per processare i reati in materia di salute e sicurezza sul lavoro.
A fianco degli ipotetici vantaggi derivanti dalla concentrazione di competenze a livello nazionale vanno posti in evidenza gli effetti collaterali indesiderati che possono derivare da questa proposta.
E' opportuno riflettere sul fatto che la "concentrazione" a livello nazionale in una procura specialistica, una specie di corpo separato, potrebbe alimentare processi di delega e di disimpegno delle procure territoriali ad investire in uomini e mezzi in a decentralized manner in the territory, in direct contact with the workplace where they consume these crimes.
